ABOUT THE INFORMATION THAT WE'VE COLLECTED FROM PUBLIC INPUT CONCERNING THE DENSITY OF SHORT TERM RENTALS. SO LOOKING AT OUR TIMELINE HERE. WE'VE HAD SOME PUBLIC INPUT HEARINGS ON SHORT TERM RENTAL REGULATIONS. WE HAD THE COUNCIL APPROVED THE ORDINANCE IN JANUARY 2024 REQUIRING PERMIT FOR SHORT TERM RENTALS. WE HAD A ONE YEAR INTERIM PROHIBITION ON SHORT TERM RENTALS, AND THAT ORDINANCE TOOK EFFECT IN JULY. WE TALKED A LITTLE BIT AT COUNCIL RETREAT ABOUT ADDITIONAL CHANGES TO THE SHORT TERM RENTAL REGULATIONS AND ADDITIONAL PUBLIC INPUT. AND SO I'M GOING TO TALK TO YOU THIS EVENING ABOUT THE PUBLIC INPUT INFORMATION THAT WE'VE COLLECTED WITH A COUPLE OF SURVEYS AND AN OPEN HOUSE, AND ALSO SINCE, SINCE WE LAST DISCUSSED THIS, WE HAD ADOPTED THE LIMIT ON 130 ACTIVE SHORT TERM RENTAL PERMITS. JUST TAKING A SNAPSHOT LOOK OF CURRENT PERMITS THAT WE HAVE. LAST TIME WE SPOKE DURING RETREAT, I BELIEVE PERMITTED SHORT TERM RENTALS WERE 77. SO NOW WE'RE AT 94. WE HAD IDENTIFIED THAT THERE WERE SHORT TERM RENTALS THAT WANTED A PERMIT DURING THE INTERIM PROHIBITION ON SHORT TERM RENTALS, AND SO THOSE HAVE NOW GONE THROUGH THE PERMITTING PROCESS. AND SO AND WE'RE LOOKING AT SOME 16 ADDITIONAL PERMITS IN PROGRESS. SO EVENTUALLY THOSE WILL GET A PERMIT. SO WE'RE WE'RE LOOKING AT 110 COMBINED YOU KNOW APPLICATIONS AND PERMITS FOR SHORT TERM RENTALS. SO LOOKING AT THAT THRESHOLD COMING UP ON ON 130. ANY ANY THAT HAVE NOT BEEN PERMITTED HAVE GONE THROUGH THE NOTIFICATION PROCESS. AND CITATIONS HAVE BEEN ISSUED. AND SO THEY'RE WORKING THEIR WAY THROUGH THROUGH COURT AT THIS POINT IN TIME. HOTEL OCCUPANCY TAX. LOOKING AT THE PERMITTED LOCATIONS. AND IF THOSE SHORT TERM RENTALS ARE REMITTING OR REPORTING HOTEL OCCUPANCY TAXES, ABOUT 33% OF THOSE ARE ACTUALLY REMITTING OR REPORTING HOTEL OCCUPANCY TAXES. SOMETHING TO KEEP IN MIND IS THAT WE'VE JUST PERMITTED, YOU KNOW, QUITE A FEW OF THESE 20, 30 PERMITS. AND SO THEY'RE THEY'RE KIND OF NEW IN THE PROCESS AND MAY NOT HAVE REPORTED YET. BUT BUT THIS IS SOMETHING THAT, THAT WE'RE LOOKING AT, THE FINANCE DEPARTMENT IS LOOKING AT CREATING A NOTIFICATION LETTERS TO TALK TO THEM ABOUT THE PROCESS SO THAT WE CAN GET THAT INFORMATION OUT. AND AFTER THOSE LETTERS GO OUT, CODE ENFORCEMENT WILL BEGIN ENFORCEMENT MEASURES. AND JUST AS A REMINDER TO COUNCIL THAT AS THESE COME UP FOR RENEWAL, THAT THEY WILL NOT BE THEIR PERMIT WON'T BE REISSUED IF THEY'RE NOT CURRENT ON EITHER REPORTING OR REMITTING THOSE THOSE HOTEL OCCUPANCY TAXES. SO DO WE HAVE ANY IDEA, LIKE HOW MUCH THESE STRS ARE BEING RENTED OUT? JUST I MEAN, ARE ARE THESE ARE. DO WE HAVE STRS THAT ARE PERMITTED THAT AREN'T ACTUALLY STRS THAT ARE OPERATING IN THERE JUST HOLDING A PERMIT TO KEEP SOMEBODY ELSE FROM HAVING ONE? SO IT TAKES A LITTLE BIT OF INVESTIGATION TO KNOW WHETHER OR NOT THEY'RE THEY TRULY HAVE STAYS OR NOT. ONE OF THE WAYS THAT WE LOOK AT THAT IS IF THEY HAVE COMMENTS FROM PEOPLE THAT HAVE HAVE STAYED IN THE SHORT TERM RENTAL. SO WE CAN DEDUCT THAT THEY ACTUALLY DID HAVE A STAY. AND THE OTHER PART OF THAT IS, YOU KNOW, MAYBE THEY JUST HAVEN'T RECORDED A ZERO WITH WITH THEIR HOTEL OCCUPANCY TAXES AND THEY'RE JUST BEHIND IN DOING THAT. SO IT TAKES A LITTLE INVESTIGATION ON EACH ONE. BUT WHETHER THEY'RE THEY'RE NOT REPORTING OR THEY'RE NOT PAYING FOR THEIR HOTEL OCCUPANCY TAXES, THAT WOULD PREVENT THEM FROM FROM ANY TYPE OF RENEWAL. A LOT OF THESE WILL BE COMING UP FOR RENEWAL. AND IN AUGUST, SEPTEMBER, I HAVE THE SAME QUESTION, BUT PROBABLY FROM THE OPPOSITE SIDE, WHICH IS THIS, THIS THIS IS BASICALLY AN HONOR SYSTEM, RIGHT? THERE'S NO AUDIT AVAILABLE TO US TO GO BACK AND SAY, YOU KNOW, HEY, YOU RENTED OUT FOR 100 DAYS, BUT YOU'VE ONLY REGISTERED FOR SIX DAYS, ARE THEN GOING BACK AND TRYING TO CORRELATE COMMENTS AND GO BACK AND MAKE A THUMB IN THE AIR. WE ARE SEEING LIMITING SHORT TERM RENTALS TO CERTAIN ZONING DISTRICTS THAT WORK FOR, YOU KNOW, ARLINGTON SITUATION, BUT MAY NOT WORK FOR LOUISVILLE. WHEN WE LOOK AT SPECIFIC ZONING DISTRICTS. THERE CURRENTLY AREN'T ANY SHORT TERM RENTALS IN OUR OLD TOWN ENTERTAINMENT DISTRICT. BUT FURTHER DOWN, YOU KNOW, LOOKING AT, YOU KNOW, 64% OF RESIDENTS THINK THAT THERE SHOULD BE MINIMUM DISTANCE REQUIREMENTS BETWEEN SHORT TERM RENTALS. 71. THINK THAT THERE SHOULD BE SOME SORT OF LIMITATIONS ON DENSITY FOR APARTMENTS. SO YOU HAVE TO LOOK AT MULTIFAMILY ZONING COMPLETELY DIFFERENT. AND MOST CITIES THAT THAT ARE LOOKING AT THAT SORT OF THING ARE LOOKING AT A PERCENTAGE OF, OF UNITS WITHIN THE APARTMENT COMPLEX. THAT WOULD BE BE ALLOWED A SHORT TERM RENTAL PERMIT. AND ALSO SETTING A NUMBER OF PERCENT OF SHORT TERM RENTALS ON A STREET OR BLOCK. SO LONG STORY SHORT, THE MAJORITY OF RESIDENTS THINK THAT THERE NEEDS TO BE SOME DENSITY LIMITATIONS IN SOME WAY.THE OPEN HOUSE THAT WE HELD, YOU KNOW, SENDING THAT INFORMATION OUT, WE WERE COLLECTING INFORMATION ON IF THEY WERE HOMEOWNERS, IF THEY LIVE IN LEWISVILLE, REALLY SPEAKING WITH THE RESIDENTS THAT CAME, I SAW TWO ENDS OF THE SPECTRUM. I SAW SHORT TERM RENTAL OWNERS THAT MAY OWN MULTIPLE SHORT TERM RENTALS. AND THEN I ALSO SAW FOLKS THAT WERE, YOU KNOW, COMPLETELY AGAINST SHORT TERM RENTALS AND DIDN'T WANT SHORT TERM RENTALS AT ALL. AND SO I FELT LIKE I WAS SPEAKING WITH, YOU KNOW, BOTH ENDS OF THE SPECTRUM. AND WHEN WE LOOKED AT THE DATA, THAT'S KIND OF WHAT WHAT WE ALSO SEE. AND THEN THE SURVEY THAT WE WERE RUNNING AFTER THAT OPEN HOUSE ASKING THE SAME QUESTIONS, WE HAD THAT OPEN FOR A WEEK AND DID THAT OUTREACH TO THAT SAME LIST OF CONTACTS THAT WE HAVE. WE ALSO PROMOTED THIS ON SOCIAL MEDIA MULTIPLE TIMES TO TRY TO GET THE MOST GET THE INFORMATION OUT THERE SO THAT IF RESIDENTS WANTED TO RESPOND, THEY WERE THEY WERE ABLE TO DO SO. SO THIS KIND OF GOT STUCK LOOKING AT SHORT TERM RENTAL REGULATIONS, YOU'RE SEEING 30% DISAGREE, 30% 34% NEUTRAL, 31 AGREE. SO THAT DIDN'T NECESSARILY HELP ME OUT A WHOLE LOT. ON IF FOLKS WERE CURRENTLY SATISFIED WITH THE REGULATIONS, BUT ALSO LOOKING AT THE DATA FROM THE OPEN HOUSE AND THE FOLLOW UP SURVEY. WE ARE SEEING THAT 4,048% OF RESIDENTS WANTED, I THINK THAT SHORT TERM RENTALS SHOULD BE ALLOWED IN MULTI-FAMILY, BUT WE'LL TALK ABOUT KIND OF WHAT THEIR THOUGHTS ARE FOR THOSE DENSITY RESTRICTIONS. I PROVIDED COUNCIL SOME ADDITIONAL INFORMATION ON LINEAR DISTANCE FOR SINGLE FAMILY RESIDENTIAL AND. BLOCK FACE PERCENTAGE FOR SINGLE FAMILY RESIDENTIAL. AND THEN ON THE BACK SIDE OF THAT FIRST PAGE IS THE INFORMATION ON WHAT CITIES ARE DOING FOR MULTI-FAMILY. IT'S JUST BLOWN UP A LITTLE BIT BIGGER. SHOULD THOSE COUNT TOWARDS OUR 130 SHORT TERM RENTAL LIMIT. AND SO 61% OF THE RESIDENTS WERE THINKING THAT KEEPING IN MIND THAT, YOU KNOW, WE HAVE ABOUT 26,000 APARTMENT UNITS, YOU KNOW, 5% OF THAT COULD REPRESENT, YOU KNOW, 1300 SHORT TERM RENTAL UNITS. SO. THE INFORMATION HERE KIND OF SHOWS THAT MAYBE FOLKS THINK THAT THAT SHOULD BE INCLUDED IN THE 130 SHORT TERM RENTAL LIMIT KEY RESULTS. ALSO, WE FOUND WITH THE DISCUSSION ON THE BLOCK FACE THE INFORMATION THAT WE SHOWED DURING THE OPEN HOUSE WAS SHOWING 1 TO 2 SHORT TERM RENTALS PER PER BLOCK BASE. WHEN WE LOOK AT OUR SURVEY CITIES AND, YOU KNOW, WE DON'T REALLY HAVE ANY OF OUR SURVEY CITIES UTILIZING THE BLOCK FACE. I THINK THE DISCUSSION AT COUNCIL RETREAT WAS MAYBE LOOKING AT DENSITY, WHERE WE WERE LOOKING AT BLOCK FACE, AND WE WERE ALSO LOOKING AT LINEAR DISTANCE. BUT, YOU KNOW, YOU'VE GOT CORPUS CHRISTI, EULESS, SAN ANTONIO, SAN MARCOS WHERE THEY'RE LOOKING AT A ONE OR PERCENTAGE PER PER FACE, BUT BUT NOTHING, NOTHING REALLY GOING ON IN OUR SURVEY CITIES. IF YOU'RE LOOKING AT 1000FT, IF YOU'RE LOOKING AT 500FT, IT COULD BE, I THINK 12 OR 1300 WAS THE NUMBER THAT WE CAME UP WITH. IF EVERYTHING WAS WAS SPACED OUT, I DON'T KNOW THAT I WOULD COUNT ON THE HOMEOWNER ASSOCIATION ENFORCING THAT. THAT IS THAT IS IN THE RULES.
