THE FIRST ITEM ON THE AGENDA IS THE APPROVAL OF MINUTES FROM OUR LAST MEETING. I WILL NOW ENTERTAIN A MOTION TO ENTERTAIN THE MINUTES AS PRESENTED. MOTION TO APPROVE ?

ZONING BOARD OF ADJUSTMENT, SO, THE RULES OF PROCEDURE ARE RULES THAT THE BOARD -- KIND OF WHEN THE REGULAR MEETINGS ARE , AND ALSO ADDRESSES THE OFFICERS, WE HAVE A CHAIR AND A VICE CHAIR, WE HAVE A PROVISION FOR AN ACTING CHAIR, SHOULD BOTH THE CHAIR AND VICE CHAIR BE ABSENT, HOW WE ESTABLISH FOR THAT MEETING. IT TALKS ABOUT HOW THINGS GET PLACED ONTO OUR AGENDA. WE TALK ABOUT OUR MEETINGS PROCEDURES. THE QUORUM OF VOTES REQUIRED TO APPROVE THE ITEM, 75%, 3/4, 3 OUT OF 4, ALL VOTING IN THE SAME WAY. WE TALK ABOUT ALTERNATIVE MEMBERS AND HOW WE HAVE THEM COME IN WHEN WE HAVE A MEMBER ABSENT. IT LAYS OUT THE GENERAL PROCESS FOR PUBLIC HEARINGS. HOWEVER, THOSE MAY BE MODIFIED BY THE CHAIR. IT DOES PUT FIVE MINUTES PER SPEAKER, AS KIND OF A GENERAL LIMIT ON SPEAKING. THAT DOES NOT INCLUDE A PRESENTATION BY STAFF OR THE INITIAL PRESENTATION BY THE APPLICANT WITH ANY OTHER REBUTTALS OR COMMENTS. AND THEN, WE DO TALK ABOUT PUBLIC COMMENTS THAT ARE NOT PUBLIC HEARINGS, IF PEOPLE WANT TO SPEAK ON THIS ITEM, SAY, OR THE PEOPLE WANT TO COMMENT ON ITEMS THAT ARE NOT ON THE AGENDA, WE LIST PROCEDURES FOR HOW WE CAN STILL HEAR THAT. WE TALK ABOUT WITHDRAWAL, IF SOMEONE WANTS TO CONTINUE AN APPLICATION. WE TALK ABOUT CLOSED SESSIONS, IF WE DO NEED TO CONVENE INTO A CLOSED SESSION AND FINAL DECISIONS , HOW THAT HAPPENS. AND THEN THE MAINTENANCE OF THE RULES AND PROCEDURES. WE WANT TO MAKE SURE THAT WE ARE REAFFIRMING THESE ANNUALLY TO MAKE SURE THAT EVERYONE IS ON THE SAME PAGE AND REFRESHING THEMSELVES. THIS IS THE KIND OF THING THAT IS FAIRLY EASY TO FORGET , IF YOU ARE NOT LOOKING AT IT ON AT LEAST A SOMEWHAT REGULAR BASIS. THIS BOARD DOES NOT MEET EVERY MONTH, WE FELT THAT WOULD BE A GOOD THING TO DO. DOES ANYBODY HAVE ANY QUESTIONS? OR COMMENTS?

ITEM IS A PUBLIC HEARING, A PUBLIC HEARING CONSIDERATION OF A VARIANCE REQUEST TO ALLOW A 40-FOOT HEIGHT DWELLING UNIT, EXCITING -- EXCEEDING THE MAXIMUM HEIGHT OF 35 FEET BY FIVE FEET, LOCATED AT 1124 LONG ISLE LANE , LEGALLY DESCRIBED AS CASTLE HILLS , PHASE THREE, SECTION C, BLOCK D, LOT 18, ZONE AND PLANNED DEVELOPMENT, TOWNE ESTATE DISTRICT , AS REQUESTED BY RAFAEL CACHUTT, FORWARD BUILDER, THE APPLICANT ON BEHALF OF MADHUSUDHAN REDDY, THE PROPERTY OWNER. CASE NUMBER 25-

11-TO- Z BOA . >> THERE ARE MUCH LARGER BUILDING LOTS THEN TYPICALLY FOUND IN THE CITY OF LEWISVILLE.

IT EXCEEDS THE 35-FOOT MAXIMUM THAT IS ALLOWED IN THE PLANNED DEVELOPMENT TOWN ESTATE DISTRICT. SEVERAL HOUSES HAVE BEEN APPROVED WITH HEIGHTS THAT EXCEED THIS, THIS REQUIREMENT BY ZONING. AND THE MAJORITY OF THE HOMES IN THIS NEIGHBORHOOD DO EXCEED THE 35-FOOT REQUIREMENT.

REQUESTING A VARIANCE TO ALLOW THE 40-FOOT HEIGHT, IT IS NOW , STAFF SUPPORTS THE 40-FOOT ASK. THAT WAY IF THERE ARE ANY CHANGES OR VARIANCES , THE HOUSE WILL STILL BE CONFORMING. THIS NEIGHBORHOOD DOES HAVE MUCH TALLER HOUSES THAN ZONING ALLOWS FOR. THE NEXT STEP , INCREASE THE BASE HEIGHT FOR THIS AREA TO FIX ANY EXISTING NONCONFORMITIES AND ALLOW THE CHARACTER OF THIS NEIGHBORHOOD TO BE PRESERVED FOR THE HOUSES THAT ARE IN THIS NEIGHBORHOOD. I AM HAPPY TO ANSWER ANY QUESTIONS. WE DID RECEIVE LETTERS OF SUPPORT FROM THE ADJACENT PROPERTY OWNERS.
