THAT'S WHERE TWO ACRES PET CEMETERY IS.WHAT YOU'LL FIND IS THERE'S A LOT OF SINGLE FAMILY HOMES THAT BACK UP ONTO PARKER ROAD.
THERE'S A SCHOOL, THERE'S A COMMUNITY CENTER, WHICH IS COMMUNITY CENTER, WHICH IS BEING BUILT.
THERE'S SOME COMMERCIAL PROPERTIES THAT SIT ON EACH SIDE OF PARKER ROAD.
A FIVE STORY BUILDING IS NOT APPROPRIATE FOR THIS AREA.
THE ONLY OTHER MULTI-STORY BUILDINGS WITHIN THE AREA THAT SIT ON PARKER ROAD ARE NO MORE THAN TWO STORIES TALL, AND THEY ARE NOT ON AN ELEVATION AS HIGH AS THIS PROPOSED LOT, AND THEY DON'T TAKE AWAY THE PRIVACY FROM THE SURROUNDING NEIGHBORS.
THIS LOT IS MUCH HIGHER IN ELEVATION THAN ANY OTHER BUILDINGS OR HOMES ON PARKER ROAD WITHIN THE AREA OF CONCERN, AND IT WILL DEFINITELY AFFECT THE PRIVACY OF THE HOMEOWNER.
A FIVE STORY BUILDING IS OUT OF CHARACTER FOR THIS AREA.
IT'S JUST NOT APPROPRIATE GIVEN THE STYLE OF RESIDENTIAL THAT IT WILL SURROUND.

SO THE LEWISVILLE CITY COUNCIL HAS CALLED A CHARTER AMENDMENT ELECTION TO BE HELD ON SATURDAY, MAY THE 3RD, SO THAT VOTERS CAN DECIDE ON SIX PROPOSITIONS DEALING WITH POTENTIAL GOVERNANCE CHANGES.
SO ANY CHANGE TO THE CHARTER DOES HAVE TO BE APPROVED BY A ELECTION.
A GENERAL ELECTION WITH THE PUBLIC. SO HOW ARE THE PROPOSED AMENDMENTS SELECTED? WELL, THE CITY COUNCIL APPOINTS A FIVE MEMBER CHARTER REVIEW COMMISSION, AND THIS COMMISSION MEETS PERIODICALLY.
THEY REVIEW THE CHARTER AND THEY MAKE RECOMMENDATIONS BACK TO THE CITY COUNCIL.
THEY MET THROUGH THE FALL AND REPORTED BACK TO COUNCIL IN JANUARY WITH SIX PROPOSED AMENDMENTS.
AND WHERE COULD I FIND THE FULL TEXT ON THESE PROPOSED AMENDMENTS? WELL, I'M GOING TO GO THROUGH THEM, BUT YOU CAN FIND THEM ON OUR WEBSITE. CITY OF LEWISVILLE 2025 CHARTER. SO THE CITY CHARTER WAS ORIGINALLY ADOPTED IN 1963 WHEN LEWISVILLE BECAME A HOME RULE MUNICIPALITY AND IT ESTABLISHED OUR CURRENT COUNCIL MANAGER FORM OF GOVERNMENT. THE CHARTER WAS MOST RECENTLY AMENDED IN MAY OF 2021, AND THE CHARTER REVIEW COMMISSION MUST BE APPOINTED AT LEAST ONCE EVERY FIVE YEARS, BUT CHARTER ELECTIONS CAN BE HELD NO MORE FREQUENTLY THAN EVERY TWO YEARS, AND IN MAY OF 2021, WE HAVE THAT CHARTER ELECTION IN PREPARATION OF THE ANNEXATION OF CASTLE HILLS, AND IT ADDED A NEW COUNCIL SEAT AND SOME OTHER THINGS.
SO THE PROPOSED SIX PROPOSITIONS ARE ALPHABETICAL.
WILL START WITH PROPOSITION A IS SHOULD THE CHARTER BE AMENDED THROUGHOUT TO CORRECT NON SUBSTANTIVE ERRORS SUCH AS CAPITALIZATION, PUNCTUATION AND GRAMMAR, HARMONIZING CONFLICTING SECTIONS, AND ELIMINATE REFERENCES TO POSITION TITLES THAT NO LONGER EXIST.
PROPOSITION B SHOULD THE CHARTER BE AMENDED TO ELIMINATE THE READING OF ORDINANCES AT OPEN MEETINGS ON THREE SEPARATE DAYS, ALLOWING THE PASSAGE OF AN ORDINANCE AT A SINGLE MEETING WITHOUT THE NEED TO DECLARE AN EMERGENCY? SO HOW DO WE HANDLE THIS CURRENTLY? SO CURRENTLY, THE CITY COUNCIL DECLARES AN EMERGENCY AS CONSTRUED BY THE CHARTER, SO THAT THE CAPTIONS OF ORDINANCES THEY APPROVE ONLY HAVE TO BE READ AT ONE MEETING.
AN EMERGENCY DECLARATION REMOVES THAT REQUIREMENTS, SO WE ONLY READ THEM AT ONCE.
OTHERWISE, THEY WOULD HAVE TO BE READ AT TWO SUBSEQUENT MEETINGS.
AND WHAT PROCESS IS USED IN OTHER CITIES? WELL, WE LOOKED AT 17 COMPARISON CITIES, AND 88% REQUIRE JUST A SINGLE READING AND 12% REQUIRE TWO READINGS. NONE OF OUR COMPARISON CITIES REQUIRED THE THREE READINGS.
PROPOSITION C. SHOULD THE CHARTER BE AMENDED TO ALLOW THE CITY MANAGER, INSTEAD OF CITY COUNCIL TO APPOINT, REMOVE AND ASSIGN DUTIES TO THE CITY SECRETARY? SO CURRENTLY THE CITY SECRETARY IS APPOINTED BY THE CITY COUNCIL.
RESPONSIBILITIES ASSIGNED TO THE CITY SECRETARY BY THE CITY CHARTER ARE TO GIVE NOTICE OF COUNCIL MEETINGS, KEEP MINUTES OF COUNCIL MEETINGS, KEEP OFFICIAL RECORDS, MINUTES ORDINANCES, RESOLUTIONS, AND THEN PERFORM OTHER DUTIES ASSIGNED BY THE CITY COUNCIL OR THE CITY CHARTER.
SO IF THIS CHANGES, WOULD IT CHANGE THE RESPONSIBILITY OF THE CITY SECRETARY? NO. YES AND NO. SO ANYTHING THAT'S ASSIGNED TO THE CITY SECRETARY THROUGH THE CHARTER WOULD STILL BE THE ROLE OF THE CITY SECRETARY.

BUT IF THIS HAD CHANGED, THEN THE CITY MANAGER, AS OPPOSED TO CITY COUNCIL, COULD GIVE THEM OTHER TASKS AND DIRECTIONS.WHAT IS THE PRACTICE IN OTHER CITIES? SO AGAIN, AMONGST THOSE 17 COMPARISON CITIES, 64% OF CITY SECRETARIES ARE SUPERVISED BY THE CITY MANAGER. PROPOSITION D SHOULD THE CHARTER BE AMENDED TO REQUIRE MAYORAL OR COUNCIL MEMBER CANDIDATES TO SUBMIT A PETITION SIGNED BY QUALIFIED VOTERS OF THE CITY ELIGIBLE TO VOTE FOR THE CANDIDATE EQUAL IN NUMBER TO THE NUMBER OF SIGNATURES REQUIRED FOR A CANDIDATE PETITION BY STATE LAW, AND TO ELIMINATE THE REQUIREMENT FOR A LOYALTY AFFIDAVIT.
SO WHAT'S THE CURRENT REQUIREMENT IF YOU WANT TO RUN FOR MAYOR OR CITY COUNCIL IN LEWISVILLE, CURRENTLY YOU HAVE TO BE A QUALIFIED VOTER OF THE CITY.
YOU HAVE TO HAVE RESIDED FOR AT LEAST ONE YEAR IMMEDIATELY PRECEDING THE ELECTION WITHIN THE CORPORATE LIMITS OF THE CITY, OR HAVE BEEN A RESIDENT FOR AT LEAST ONE YEAR IMMEDIATELY PRECEDING THEIR ELECTION OF ANY TERRITORY NOT FORMERLY WITHIN THE CORPORATE LIMITS, BUT WHICH HAS BEEN ANNEXED. MEMBERS OF THE CITY COUNCIL ADDITIONALLY SHALL HAVE RESIDED CONTINUOUSLY IN THEIR COUNCIL DISTRICT FOR SIX MONTHS PRIOR TO THEIR REGULAR FILING DEADLINE, HAVE RESIDED OR AGAIN IN AN AREA THAT WAS ANNEXED.
ADDITIONALLY, THE MAYOR AND EACH MEMBER OF THE CITY COUNCIL SHALL NOT BE IN ARREARS IN THE PAYMENT OF ANY TAXES OR OTHER LIABILITIES DUE TO THE CITY, AND SHALL NOT HOLD ANY OTHER OFFICE OR EMPLOYMENT UNDER CITY GOVERNMENT WHILE A MEMBER OF COUNCIL.
WHAT EXACTLY IS THE LOYALTY AFFIDAVIT? SO THEY CURRENTLY HAVE TO SIGN AN AFFIDAVIT STATING THEY WILL SUPPORT AND DEFEND THE CONSTITUTION LAWS OF THE UNITED STATES OF TEXAS AFFIRMING THEIR CITIZEN SAYING THAT THEY'RE CAPABLE TO PERFORM THE ROLE AND THEY'RE NOT MENTALLY INCOMPETENT.
AS STATED, WITHOUT THE RIGHT TO VOTE, THEY'RE AWARE OF NEPOTISM LAWS THEY DON'T HAVE.
THEY'VE DISCLOSED ANY PRIOR FELONY CONVICTIONS AND PROVIDED PROOF, IF THEY'VE BEEN CONVICTED, THAT THEY'RE PARDONED OR OTHERWISE RELEASED FROM THE RESULTING DISABILITIES OF SUCH CONVICTION. AND SO YOU CAN READ THE REST OF THAT ON THE SCREEN.

SO IF PROPOSITION D PASSES, WHAT WILL THE PETITION REQUIREMENT FOR MAYORAL AND CITY COUNCIL CANDIDATES BE? SO FUTURE CANDIDATES WOULD BE REQUIRED TO SUBMIT A PETITION CONTAINING THE NUMBER OF SIGNATURES REQUIRED FOR A CANDIDATE PETITION BY STATE LAW.
STATE LAW REQUIRES THE NUMBER OF SIGNATURES TO BE THE GREATER OF 25, OR ONE HALF OF 1% OF THE TOTAL VOTES RECEIVED BY ALL CANDIDATES IN THE MOST RECENT MAYORAL GENERAL ELECTION. SO AS OF TODAY, LEWISVILLE CANDIDATES WOULD BE REQUIRED TO PROVIDE AT LEAST 27 SIGNATURES.
SO WHAT IS THE PRACTICE FOR CANDIDATE QUALIFICATIONS IN OTHER CITIES? SO 59% OF THE COMPARISON CITIES EITHER REQUIRE A PETITION IN ALL CASES, OR REQUIRE A PETITION IN LIEU OF A FILING FEE JUST AS REFERENCE.
WE'RE NOT PROPOSING TO DO THAT. AND IN SOME OF THOSE CITIES, IF YOU DON'T PAY THE FEE, THEN YOU CAN SUBMIT A PETITION AND SIT DEAD. NONE OF THE OTHER CITIES REQUIRE A LOYALTY AFFIDAVIT. SO PROPOSITION E, SHOULD THE CITY CHARTER BE AMENDED TO INCREASE THE NUMBER OF CITIZENS SERVING ON THE CHARTER REVIEW COMMISSION FROM 5 TO 7? SO THE CHARTER REVIEW COMMISSION, AS I MENTIONED, IS APPOINTED AT A MINIMUM EVERY FIVE YEARS TO CONSIDER THE CHARTER.
THEY PROVIDE PROPOSED AMENDMENTS TO THE CITY COUNCIL.
AND THEN AGAIN, THE CITY CHARTER CAN ONLY BE AMENDED BY A CITY WIDE ELECTION.
THE CHARTER REVIEW COMMISSION IS APPOINTED BY THE CITY COUNCIL.
A CHANGE FROM 5 TO 7 MEMBERS WOULD RESULT IN THE COMMISSION BEING THE SAME SIZE AS THE CITY COUNCIL.
AND THEN PROPOSITION F SHOULD THE CHARTER BE AMENDED TO INCREASE COMPENSATION FOR THE MAYOR AND COUNCIL MEMBERS FROM $50 FOR EACH MEETING TO $400 PER MONTH FOR THE MAYOR AND 300 PER MONTH FOR EACH COUNCIL MEMBER. SO WHAT IS THE CURRENT COMPENSATION? RIGHT NOW THEY GET $50 PER OFFICIAL MEETING. THERE'S TWO REGULARLY SCHEDULED COUNCIL MEETINGS PER MONTH.
HOW DOES THIS COMPARE TO SIMILAR CITIES? SO LOOKING AT 15 COMPARABLY SIZED CITIES.
THE AVERAGE MONTHLY COMPENSATION IS $697 FOR THE MAYOR AND $469 FOR COUNCIL MEMBERS.
SO IF PROPOSITION F PASSES, WILL THIS INCREASE IMPACT THE CITY BUDGET OR RAISE TAXES? SO THE TOTAL COST IF THIS WERE TO PASS WOULD BE 26,400 PER YEAR.
